The second was when Jane Russell asked whether, if you could not explain how Upton’s screenshots were created, the only explanation is that Upton was lying about the creation dates. Jim Borwick said that he couldn’t create what Upton claims has happened and that it’s impossible

At that point during a back and forth with the Judge, Jane Russell noted that on her interpretation of the evidence, the answers given said that Upton was lying. The Judge was clear that this is not what the witness said, meaning that this was Jane Russell’s interpretation of it

It is absolutely extraordinarily that Jane Russell would, on no basis at all, imply that three lawyers and one forensic expert have engaged in professional misconduct in what can only be a desperate attempt to discredit evidence that is damaging to Beth Upton.

A point to note about the evidence today in Peggie v NHS Fife: Jane Russell KC was the first to suggest that the expert evidence on Dr Upton’s phone notes suggests that Upton has lied about the contemporaneousness of the notes. And she did it twice.

While the Sandie Peggie trial is ongoing? Really? Are they on glue?
