Has NHS Fife briefed its counsel to say it does not agree with the Supreme Court’s interpretation of the Equality Act? Surely not?
NC - man. He's insisted he's entitled to be there, focus on that. JR - unfair premise, DU is not a man, a she's a TW NC - .. J - there was an objection NC - DU is a TW and so DU is a man. Legally speaking in FWS EQA he's a man JR - FWS not agreed J - we need to hear submissions
It doesn't matter if there are individuals with rare medical conditions. Upton does not have a DSD. Shame on JR!
confusion over chromasomes KS - not a geneticist - XXY, XYY (cross talk) JR - asked about Pete with menacing behaviour. How would you describe DU behaviour KS - kind and compassionate, never experienced anything but kind and compassion to patients and colleagues.
Astonishing order of priorities for the Safety Lead in the dept.
NC - order of priority is surprising, more concerned about SP action to DU rather than abandoning patient care? KS - in hindsight we didn't necessarily see they were patient safety issues, all together we saw NC - even in broad terms it says shes so bigotted against DU would
So the senior consultant in this dept continues to hold that SP is guilty despite being cleared by the investigation!
KS - reported it as and still do think it's a HI NC - you are aware SP has been cleared of all KS - yes NC - board didn't find. KS - believe not enough evidence NC - email to ED, you say SP hard to work with before today, beth has a log of less severe incidents

“Periods aren’t sexual, so boys mocking them isn’t either.” —Dr Upton. This was his response to questions about whether menstruation-related taunts were sexually harassing. 📄 (9/15)
“If he says he’s a woman, he’s a woman. That’s the rule.” —Isla Bumba. There was no trans policy at NHS Fife. But this was the de facto rule. 📄 (5/15)
This is a very good point. Does Searle ask most female doctors if they are happy and comfortable in the women's CR?
If Theodore is not obviously a man, why did Kate Searle check with him, when he started in the A&E, which changing room he would use? If she cannot tell he is a man, she would have just assumed he would use the women's.
Our ruling is not contentious or a hypothesis. It's straightforward. According to the Equality Act, as NC says, Upton is legally and biologically a man. It isn't for Jane Russell to relitigate this at a tribunal.

It would appear from the evidence from A&E consultant Kate Searle that she thinks there is no "kind" way to raise an issue with a male doctor being in a female changing room at work if he happens to identify as female. And therein lies the madness of gender ideology.
KS - policy said intimidating or offensive in way you say, that's enough. If everyone was kind and said things another say there was no need for it to come to this. NC - think briefly about another person, not a man who thinks/wishes he was a woman - a man in mans clothes - Pete
KS says that "if everyone was just kind to each other and went about things in a different way there would be no need for things to come together like this" [i.e. a woman should just accept a man using their changing rooms]
We are looking forward to finding out what does and does not qualify as an "obvious" man.
NC - SP tried to reason, he says asked about chromasomes, we say not, but not offensive KS - yes it is invasive and intimidating NC - it's a polite way of discussing fact of body not mentioning genitals. You might think it's more polite JR - object, DU is not obviously a man
Sandie Peggie was repeatedly asked to respect confidentiality while meanwhile consultants shared information, an email group was set up which included consultants, the investigator & Dr Upton to share updates, and noone else was it appears reminded of confidentiality.
Classism is heart of Sandie Peggie’s case - Nurses are ten a penny, but add nothing to the diversity portfolio or speaking tour opportunities. They complain because that’s what the working classes do when they aren’t being homophobic or using racial slurs heraldscotland.com/politics/viewp…

doctors need to know the sex of their patients for multiple clinical (safety) reasons. Sex is determined at conception and recognised often in utero and described at birth. It's not assigned like a random dicethrow. We know this.
