Every conservative should *hate* qualified immunity. It was invented by a few judges & lets government workers break the law—in cartoonish ways—without consequence. If you believe in limited government and hate "legislating from the bench," you really can’t defend this.
Harlow v Fitzgerald may be the best example of judicial tyranny, actually. Congress passes a law to secure Constitutional rights by holding state and local officials accountable for violating them. SCOTUS "amends" it by adding qualified immunity, largely gutting the law.
Eye-opening! Early in President Trump's term, legal commentators said the win-loss record in district courts showed unique lawlessness. Now, thanks to the all-stars at the @TheJusticeDept, the numbers (and lower courts) have reversed. Looking forward to the public reassessment!
Rachael, we didn’t bring any lawsuit to overturn the new statute. We brought a lawsuit only seeking an injunction against applying the statute to Roman Catholic confession. As I said at the outset, you have no understanding of what you’re commenting on.
This is only the injunction. The impact of overturning the new statute, should the suit overall be successful, will not be limited to the Catholic church. Courts have already suggested it can't be. And even if it is, the impact is that priests cannot report/testify on child rape.
