15. Trying civilians in Military Courts is unconstitutional and violates: Article 10-A – Right to a fair trial Article 175(3) – Judicial independence Article 9 – Security of person Article 14 of ICCPR – Right to a competent, independent, and impartial tribunal
14. No objective or legal criteria have been provided for deciding who is tried in Military Courts and who in Anti-Terrorism Courts (ATCs) — amounting to selective prosecution and violating the principle of natural justice. Its arbitrary, capricious and exfacie discretiminatory
13. Media has been barred from covering the trial’s final stages, violating the principle of open justice, a cornerstone of fair judicial process in democratic societies.
12. Basic questions remain unanswered: Why were security barriers removed? Why was a crowd allowed to gather? Why has key CCTV footage been hidden? Such omissions suggest state complicity or gross negligence, neither of which have been accounted for in trial.
11. Despite being stationed in the area, no military personnel have been called as witnesses — raising serious questions about the completeness and impartiality of the prosecution.
