Kate Searle says "I don't know all the rules" [kind of sums things up]
Kate Searle says she does not agree with Naomi Cunningham when she says "the usual rules don't apply, do they, when it comes to Dr Upton?"
When asked if she knew that Sandie Peggie had been cleared of any wrong doing in the internal disciplinary hearing and that this was not a hate incident, KS says "I believed there was not enough evidence".
Kate Searle says "I reported it because I believed at the time and still do that this was a hate incident"
Kate Searle says as the person responsible for Dr Upton's well being she was reporting the incident as it occurred and why it was offensive.
Naomi Cunningham says that we see on the Datix is Kate Searle "turning up the heat" on the incident.
The Datix written by KS also refers to Sandie's "aggressive and confrontational manner" but those were not words used by Dr Upton. KS says she is reporting the facts on the Datix as they were at the time from Dr Upton.
Kate Searle when asked why the word 'rapist' was added to the Datix report when that was not said says it was "offensive". KS says she wrote that the nurse "alluded" to a convicted rapist.
Kate Searle says Sandie Peggie had alluded to Dr Upton being like a convicted rapist. KS agrees that Sandie Peggie did not say the words 'Isla Bryson'.
Naomi Cunningham says the 'woman's prison incident' was to do with the Isla Bryson case - a trans woman being in a woman's prison - but does not imply that Sandie Peggie was comparing Dr Upton with a rapist.
Discussion on whether Sandie Peggie was comparing Dr Beth Upton to a rapist or comparing the situation that she felt she was in with a man in the female changing room who says he is trans to a man claiming to be trans woman [who happens to be Isla Bryson] in a female prison.
Kate Searle says she would not have known what sex Dr Upton was assigned at birth when asked if she would have known that Dr Upton was a trans person.
NC brings out the hypothetical 'Pete' again to ask Kate Searle if she thinks it would be reasonable for 'Pete' to use the female changing rooms and if women objected and he said that he was a trans woman then he should leave. KS agrees that 'Pete's' behaviour is not reasonable.
KS says that "if everyone was just kind to each other and went about things in a different way there would be no need for things to come together like this" [i.e. a woman should just accept a man using their changing rooms]
KS says Sandie wasn't allowed to object to Dr Upton's presence in changing rooms in the manner that Dr Upton reported it to her. She says Sandie waited until Beth came out of the toilet & others had gone before confronting Beth & said offensive things like 'you are not a woman'.
NC carries on by saying Dr Upton is a trans identifying man i.e. a trans woman who is a man...
Jane Russel objects to the premise of a question from Naomi Cunningham that Dr Upton is a man when JR says that Dr Upton is not a man, she is a transwoman. NC says that is not the case and that a transwoman is a man.
Kate Searle has broken down in tears again and asked if she requires a break which she has refused.
