We are in 2025 in an employment tribunal and debating the use of the word 'heresy' 🧙♀️
Naomi Cunningham arguing that the Board's treatment of Sandie Peggie was because they believed her to be a heretic. A discussion about the word 'heresy' and its use is now continuing.
Naomi Cunningham continues to question witness using he/him pronouns for Dr Upton.
Jane Russell asks for Naomi Cunningham to reflect on her language. Judge asks NC if she needs time to reflect, she does not.
Jane Russell raising what she says is creating a 'hostile environment' by Naomi Cunningham using pronouns he/him for Dr Upton which she says is confusing witnesses who have not heard Dr Upton being referred to in this way.
Angela Glancy says that although Sandie Peggie was on a list of six people including Beth Upton and Kate Searle that they would speak to as part of the investigation, the other five would be spoken to first.
Angela Glancy says once report is compiled option are, nothing to answer; determine there maybe some learning to do with an action plan; and lastly that report is taken forward for a conduct or capability hearing.
Angela Glancy was given no details but said she had scope to be the investigating manager. Says the role is to be impartial and determine facts.
Angela Glancy says she was called on Teams in Feb 2024 by Gillian Malone to ask if whether her or a colleague had scope to do an investigation.
Angela Glancy worked for FHB for almost 28 years clinical nurse manager & known Sandie Peggie for at least 20 years. Says never had any issues with SP. Was not aware of GC views.
Someone sensible in HR reiterates “no evidence” and points to a 30 year unblemished record in nursing - and yet still they persisted
One of the witnesses at Sandie Peggie's tribunal tomorrow will be Anne Hamilton from HR. We had a look at the evidence bundle today. It seems HR was advising fairly strongly there were preferable alternatives to suspending Sandie Peggie, and that any risk could be mitigated.
Some things are binary. You are either Team Peggie or Team Upton. And most of our politicians chose to be Upton. thetimes.com/article/ba6130…
Our ruling is not contentious or a hypothesis. It's straightforward. According to the Equality Act, as NC says, Upton is legally and biologically a man. It isn't for Jane Russell to relitigate this at a tribunal.
NC - man. He's insisted he's entitled to be there, focus on that. JR - unfair premise, DU is not a man, a she's a TW NC - .. J - there was an objection NC - DU is a TW and so DU is a man. Legally speaking in FWS EQA he's a man JR - FWS not agreed J - we need to hear submissions
Kate Searle says "I don't know all the rules" [kind of sums things up]
Kate Searle says she does not agree with Naomi Cunningham when she says "the usual rules don't apply, do they, when it comes to Dr Upton?"
When asked if she knew that Sandie Peggie had been cleared of any wrong doing in the internal disciplinary hearing and that this was not a hate incident, KS says "I believed there was not enough evidence".
Kate Searle says "I reported it because I believed at the time and still do that this was a hate incident"
Kate Searle says as the person responsible for Dr Upton's well being she was reporting the incident as it occurred and why it was offensive.
Naomi Cunningham says that we see on the Datix is Kate Searle "turning up the heat" on the incident.
The Datix written by KS also refers to Sandie's "aggressive and confrontational manner" but those were not words used by Dr Upton. KS says she is reporting the facts on the Datix as they were at the time from Dr Upton.
