I had a miscarriage at 5 1/2 months. According to this law, I would have been put in jail. I was totally devastated by this loss for years. If I had to go thru the whole court and jail thing, I wouldn’t be here today. I would have offed myself because it would have been too much.

If you have special duty to care for a dependent, you may use your body instrumentally to provide external resources (food, shelter etc) to them. You are the agent. During gestation, your body is a resource extracted by someone else in a way that is beyond your conscious control.

Losing your pregnancy is devastating no matter when it happens. People do not deserve to be interrogated, arrested, charged and held in jail for a miscarriage. This woman’s mugshot was splashed everywhere while she was experiencing a trauma
