Dr Upton's sex is pertinent, central even, to the whole case. Upton is not in the room and even so, his counsel is policing the use of language used by the claimant's counsel.
Jane Russell raising what she says is creating a 'hostile environment' by Naomi Cunningham using pronouns he/him for Dr Upton which she says is confusing witnesses who have not heard Dr Upton being referred to in this way.
KS says that "if everyone was just kind to each other and went about things in a different way there would be no need for things to come together like this" [i.e. a woman should just accept a man using their changing rooms]
Sandie Peggie was repeatedly asked to respect confidentiality while meanwhile consultants shared information, an email group was set up which included consultants, the investigator & Dr Upton to share updates, and noone else was it appears reminded of confidentiality.

It’s understandable that some think that NHS Fife and Dr Upton don’t have an opportunity to settle with Sandie Peggie given they are the respondents but this isn’t true. They can concede liability or stop calling witnesses and move to a judgment based on the evidence so far.
They are the respondent. They don’t have the option to settle. Sandie refused, so all this rot could come out in the open.

A mindset repeated across the public sector: when deciding whether those with trans identities can use opposite sex facilities, the only people whose views carry weight are those with trans identities. The rights of others are never considered, nor those rights holders consulted.

Kate Searle met Dr Upton at 5pm on 29th December & Beth told her the events that had happened and was extremely shaken & distressed. Looked at 'hate' policy & completed a Datix together, discussed reporting to police & then looked at shift patterns & whether she felt safe.
