Jimmy Buffett Fan, Esq.

Just a D.C. attorney looking for his lost shaker of salt. Plainly not the real Jimmy Buffett, don't be daft. Tweets adhere to the standards at 1 U.S.C. § 1.
People say this is extremely stupid, and they're right. But what they forget is that it's also exactly what we deserve.
Many such cases—talented icon spawns untalented spinoffs who poorly mimic the art and ruin things for everyone. See, e.g., Justice Scalia.
Jon Stewart unintentionally broke comedy. All of his protégés (Oliver, Colbert, Bee) kept the meanness and self righteousness without the subtlety, self-awareness, and willingness to criticize his own side (remember Stewart’s re-debut was mocking Biden’s age) that made him work.
It would be absolutely incredible if Macron were the one to get NYT Co. v. Sullivan overruled. Unfortunately, Owens's statements are so absurd that Sullivan isn't likely to be outcome determinative.

There are two kinds of OLC lawyers: (1) The p(R)esident can just do things, and (2) The presi(D)ent can just do things.
Justice Thomas has this footnote in his dissent in Braidwood. Suffice it to say, I think it is very difficult to arrive at his conclusion based on the actual text of the Appointments Clause, which contains no hint of an interbrach appointment bar.
Apropos of Humphrey's Executor, SCOTUS has an annoying habit of not overruling cases and then telling lower courts "you really should've known this wasn't good law." See Bremerton re Lemon. Gorsuch is an especially bad culprit. Not sure how to reconcile with Rodriguez de Quijas.
How is this any different from political leaders saying the Supreme Court "must overturn Roe" or "must overrule Chevron"? And where is the alleged "corruption" or "threat"? This is unserious and purely performative.
🚨 House Democrat Leader @HakeemJeffries is corruptly strong-arming 17 New Jersey U.S. district judges--including 15 Obama and Biden judges--to fire New Jersey U.S. Attorney @AlinaHabba tomorrow at 10 am. @Article3Project just filed this House ethics complaint against Hakeem:
Is there any actual evidence that state-bar CLE requirements accomplish anything other than a forced wealth transfer from practicing lawyers to CLE instructors/organizations?
That's exactly what the conservative legal movement has been doing. How do you think we got rid of Roe and Chevron, or replaced Morrison with modern removal doctrine. I don't think one can credibly say conservatives aren't dogged on these policies.
While I often do not support their arguments, especially when they are illiberal, the ACLU does not take no for an answer. It will repeat arguments it believes in for decades until courts accept them. The conservative legal movement needs more of that energy.
The number of spam messages/bot accounts on this app is absolutely unreal. Remember when @elonmusk made getting rid of spam accounts a central promise when he bought the platform? So much for that.
Amy Coney Barrett is the better lawyer. Her SCOTUS tenure, 7th Circuit judgeship, Scalia clerkship, and top Notre Dame honors reflect greater impact and expertise than Josh Blackman's professorship, writings, and media commentary.
