When Dr Searle became upset, Jane Russell KC castigated Naomi Cunningham’s lack of “people skills”. Not only was the irony marked. I have no hesitation in saying that no counsel should ever say that to another in open court. And for a silk to say it to a junior is unforgivable.

Following an intervention from Jane Russell about misgendering, the judge asks Naomi Cunningham if she would like time to reflect. Naomi replies crisply, “no thank you”.
This was an extraordinary intervention. The judge already considered the use of pronouns at an open hearing in January and ruled that he would not compel the Claimant side to use "preferred pronouns" and the tribunal would try to avoid the use of pronouns in respect of Dr Upton.
I heard this and it was rather longer than this suggests. This was a substantial intervention by Jane Russell referring to the May 2025 edition of what she referred to as the Equal Treatment Bench Book (it turned out to be the England and Wales Bench Book). She repeated her claim

Correct: one of the grimmest aspects of this case is how easily these middle-class luxury-belief doctors engaged in appalling treatment of a nurse because their crazy belief system (that men are literally women if they only say so) enabled them to unfairly malign her as a bigot.

Dr Upton's sex is pertinent, central even, to the whole case. Upton is not in the room and even so, his counsel is policing the use of language used by the claimant's counsel.
Jane Russell raising what she says is creating a 'hostile environment' by Naomi Cunningham using pronouns he/him for Dr Upton which she says is confusing witnesses who have not heard Dr Upton being referred to in this way.
