Call me old fashioned, but I think the bare minimum we should expect from our medical professionals is that they know the differences between male and female human beings.

Our ruling is not contentious or a hypothesis. It's straightforward. According to the Equality Act, as NC says, Upton is legally and biologically a man. It isn't for Jane Russell to relitigate this at a tribunal.
