With 50 yes votes and 48 no votes (no need for @JDVance to break the tie) cloture is invoked on the eminently qualified Emil Bove III to be a judge on the U.S. Court of Appeals for the Third Circuit.

Any lower court judge that doesn’t get the message about removals should be considered to be willfully defying the Court.

Never mind the NYT op-ed is bad econ. It is the cruelty that gets me. Imagine the disdain for others it takes to NEED them poorer so you can slap a “big is bad” sticker on your car. Costco/WM entry reduces food $$ by 20% or more BECAUSE they extract concessions from suppliers.
The idea that lessening supplier competition by banning discounts that reduce food expenditures will make anyone better off is antitrust fan fiction indulged by the Wu-Kanter-Khan mug set with cruel consequences for real families. open.substack.com/pub/competitio…
I’m with @ATabarrok, obviously. Here is some evidence that large retailers lower prices, disproportionately help the poor, and reduce food insecurity … Sloppy RPA enforcement is more than bad economics, it’s cruel. Link below the fold.
Would Americans be better off without Costco? Zephyr Teachout says yes. I say no. marginalrevolution.com/marginalrevolu…
Emil Bove will be a judge who follows the law, not the woke mob. The establishment hates him because he tells the truth. The left fears him because he fights back. Tell your Senators to confirm Emil Bove: article3project.quorum.us/campaign/EmilB…
This is really important. And it undoubtedly applies not only to final orders and consents, but also to many currently active investigations commenced before January 20, 2025. Second chance legal and economic advocacy opportunities at the FTC for AI companies paying attention.
Nugget found in the AI Action Plan: a “review” of all FTC investigations and cases started by the last administration that would be a burden on AI innovators… may turn out to be one of the crucial pieces to dismantle and extirpate the Lina Khan anti-market competition agenda
You would fail a college student if they wrote this on an exam and yet the NYT publishes it as if it’s insightful

Thank you @POTUS for choosing one of the best to serve Missouri on the federal bench. We are proud to know that the current youngest federal judge is coming from our Office.
Awesome.
Confirmed, 51-46: Confirmation of Executive Calendar #260 Joshua M. Divine to be United States District Judge for the Eastern and Western Districts of Missouri.
The administration must end the ABA’s power over law school accreditation forthwith—instanter even.
An important, and inevitable, step on the way to overturning Humphrey’s Executor. How should the FTC adapt to life without minority commissioners? A few ideas: open.substack.com/pub/competitio…
🚨🚨🚨Breaking: Another Trump win of a temporary stay in case lower court ordered reinstatement of fired FTC presidential appointees.
Good thread from @ErikHovenkamp. Don’t be like the NY Times op-ed. Don’t spread economic misinformation. Econ 101 can help.
Lots of really bad economics in today’s NYT op-ed on grocery store competition. Take this passage for example:
