39/ Addressing the unique situation of the 🇺🇸US but without naming it, the Court affirms that States not party to one or more of the UN climate treaty must nevertheless meet equivalent obligations under customary international law.
30/ The Court then addresses States' mitigation obligations based on Article 4 of the Paris Agreement. The Court explicitly dismisses the argument put forward by some States that they have full discretion to set the ambition of national climate action.
