The final text is out, and this problem is still there! If states take any bit of the new money, their ENTIRE BEAD funds (all $42.45 Billion of them) are on the chopping block. That’s a big risk for any state who thinks they may want to legislate on AI in the next 10 years.

I just uploaded a new short commentary analyzing the latest changes to the AI moratorium text. Very little has changed. The moratorium still potentially impacts all existing BEAD funding, not just the newly appropriated $500 million.
