A justified limitation isn’t inconsistent with the Bill of Rights Act. But these electoral changes are unjustified limitations, as the Attorney-General has concluded. Parliament can legislate inconsistently with the BORA, but it can’t make an unjustified limitation justified.
Some NZ law is inconsistent with the Bill of Rights, because most rights are not absolute. Parliament has the power to declare that the limitation is justified in a free and democratic society. Such limitations are not breaches of human rights.
