Rhetorical question that I already know the answer to: What power does the executive branch have to “prohibit[] third-party, pay for play payments”? (The answer is none)
Appears President Trump has signed an executive order on college athletics. From the fact sheet, it sounds similar to the draft order released last week. But there is one very important new item. This says the order “prohibits third-party, pay for play payments” to athletes.
Two days ago I wrote a legal analysis of President Trump's expected executive order on college sports. The order is now out. Take-away point: it's not a law, it can't replace a law and any new policies that come from agencies will be challenged in court: sportico.com/law/analysis/2….

If we want the best, most competitive version of college sports, allowing international players to capitalize on their NIL without jeopardizing their visa status is an excellent step forward.

This is a very concrete example demonstrating that the new NCAA/CSC rules have no legal protection or authority. They are all still subject to antitrust attack. A model that continues to try & limit athlete comp w/o an antitrust exemption is likely a waste of time & resources.
