The Supreme Court's decision last year to send this case back to the Second Circuit was 9-0, with Justice Sotomayor writing the opinion and Justice Gorsuch and Justice Jackson writing concurrences. Notably, Justice Jackson's concurrence is cited six times in today's opinion.

In January, the OCC imposed final penalties against three former Wells Fargo execs. Two sued in DC, and the OCC in April chose to settle rather than litigate. The OCC did *not* settle with the third exec, who sued the OCC in the Eighth Circuit. Her opening brief was filed today
