It is urgent that the Presidency does their bit to hold a transparent and fair inquiry into Chauke’s fitness to hold office.
Despite the serious evidence against him, Chauke remained in office for over 20 years as Joburg’s prosecutions boss. We asked the Presidency in 2024 if they would suspend Chauke, as the NPA had requested, and they said it was a “matter between the employer and an employee”
There were several other cases where Chauke made decisions that led to unreasonable delays, including the Brian Hlongwa case that saw R1.2bn wasted on fraudulent contracts instead of improving public health. It took 10 years for Hlongwa to appear in court.
The NPA withdrew the Booysen charges in 2019 saying “a proper case was not made out…” A 2019 internal NPA investigation stated there was no sufficient evidence to charge Booysen and others. Several high profile prosecutors faced disciplinary action for their role in the case
The Mokgoro inquiry (2012) found Chauke signed a memorandum authorising charges to be brought against former Hawks officer Johan Booysen and other policemen. At the time, Booysen had been investigating businessmen linked to the Zuma family.
In our 2022 Bad Cops, Bad Lawyers report we called for an inquiry into Chauke’s fitness to hold office and for him to be placed on suspension. opensecrets.org.za/bad-cops-bad-l… There was ample evidence proving Chauke had made bad decisions which delayed important prosecutions.
