I questioned the provider of the contract (Bedouin) and was assured it was all HMRC compliant, however I did not expect the new legislation to be backdated, which seems unconstitutional and unfair in many ways @LCAG_2019 @loanchargeAPPG #LoanChargeScandal

Great, but forward acting legislation, very unlike the punitive retrospective LoanCharge. Why treat differently?
Douglas Barrowman made a fortune from selling tax avoidance schemes. When the schemes failed, his companies aggressively sold their clients another avoidance scheme which supposed rescued them from the first scheme. It was all a scam. A disaster for the clients.
We reported on this last year, and said there seemed enough evidence to prosecute Barrowman and his team for defrauding HMRC and their own clients. It's not often you accuse a billionaire of fraud and don't hear a peep out of his lawyers. Guess why. taxpolicy.org.uk/2024/01/18/bar…
There's no sign of HMRC taking action against Barrowman. But.
I just picked up on an obscure case from last month. The case reveals that HMRC is prosecuting five people for selling what looks like a very similar "avoidance" scheme - which HMRC say is really tax fraud.
HMRC is attempting to break see the advice one of the individuals received Usually tax authorities/third parties can't see legal advice 'cause of privilege. But the advice is sued for fraud, then they can - the "iniquity rule" (apologies to lawyers for the over-simplification)
