🚨 NEW: Senate discussion draft of CLARITY Act The Senate draft released today substantially changes SEC / CFTC boundaries. It removes the 'maturity' decentralization test, and replaces it with a rights-based 'ancillary asset' test.

Senate draft of CLARITY is quite different to the House version: 1) Removes 'mature blockchain' (i.e. decentralization) test 2) Adds 'ancillary assets' test from the Lummis-Gillibrand 'Responsible Financial Innovation Act' of 2022. TL;DR: More discretion + power to SEC
